Terms of Service

By accessing or using the Emotos platform, its associated services, APIs, CLI tools, or any related products (collectively, the "Services"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you must not use our Services.

These Terms apply to all visitors, users, and others who access or use Emotos. By using the Services, you represent that you are at least 18 years old and have the legal capacity to enter into these Terms in your jurisdiction.

Emotos provides security infrastructure for AI agents, including but not limited to: agent identity management, cryptographic token issuance, security policy enforcement, threat detection and response, audit logging, MCP proxy services, and related developer tooling.

We reserve the right to modify, suspend, or discontinue any part of the Services at any time, with or without notice. Emotos shall not be liable to you or any third party for any modification, suspension, or discontinuation of the Services.

To access certain features of the Services, you may be required to create an account. When creating an account, you must provide accurate, complete, and current information. You are responsible for safeguarding the password and any credentials that you use to access or control your account.

You must notify Emotos immediately of any unauthorized use of your account or any other breach of security. Emotos shall not be liable for any loss or damage arising from your failure to comply with this section. You are responsible for all activities that occur under your account.

The Services and their original content, features, and functionality are and will remain the exclusive property of Emotos and its licensors. Our trademarks and trade dress may not be used in connection with any product or service without prior written consent of Emotos, in a manner that is likely to cause confusion among consumers, or in any manner that disparages or makes false statements about Emotos.

You retain ownership of any content you submit or upload to the platform. By submitting content, you grant Emotos a non-exclusive, worldwide, royalty-free license to use, modify, reproduce, and distribute such content solely in connection with the Services.

You agree not to engage in any of the following activities:

• Using the Services for any unlawful purpose or in violation of these Terms
• Attempting to gain unauthorized access to any portion of the Services or other systems
• Interfering with or disrupting the integrity or performance of the Services
• Uploading or transmitting viruses, malware, or any malicious code
• Attempting to reverse-engineer, decompile, or disassemble any part of the Services
• Using the Services to generate, store, or transmit content that is illegal, harmful, or offensive
• Circumventing any access controls, security measures, or rate limits implemented by Emotos
• Using automated tools to scrape or harvest data from the Services without prior written permission

Certain features of the Services may be offered on a paid basis. By subscribing to a paid plan, you agree to pay all applicable fees as described on the pricing page at the time of purchase. All payments are processed securely and in accordance with PCI-DSS standards.

We may update our pricing at any time. Changes to pricing will take effect at the start of your next billing cycle. You may cancel your subscription at any time, but cancellation will not result in a refund of fees already charged for the current billing period.

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, EMOTOS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICES.

In no event shall Emotos' total liability to you exceed the total amount paid by you to Emotos in the twelve (12) months preceding the event giving rise to such liability. Some jurisdictions do not allow limitations of liability, so the above limitations may not apply to you in full.

THE SERVICES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT ANY WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. EMOTOS DOES NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.

EMOTOS DOES NOT WARRANT THAT THE RESULTS OBTAINED FROM USE OF THE SERVICES WILL BE ACCURATE OR RELIABLE. YOUR USE OF THE SERVICES IS AT YOUR OWN RISK.

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts located in Delaware.

You agree to waive any right to a jury trial and to participate in any class action or collective proceedings related to the Services.

We reserve the right to modify or replace these Terms at any time at our sole discretion. We will provide notice of any significant changes by updating the "Last Updated" date at the top of this page and, where appropriate, by sending you an email notification.

Your continued use of the Services after the effective date of any changes constitutes your acceptance of the new Terms. If you do not agree to the modified Terms, you must discontinue using the Services.

We may terminate or suspend your account and your access to the Services immediately, without prior notice or liability, for any reason, including if you breach these Terms. Upon termination, your right to use the Services will immediately cease.

You may terminate your account at any time by contacting our support team. Upon termination, we will handle your data in accordance with our Privacy Policy.
